Next NY Secure Choice Registration Due on May 15
As a reminder, the New York Secure Choice Program requires New York employers with 10 or more employees who do not offer a qualified retirement plan to automatically enroll their employees in this new state-sponsored retirement plan.
Employers with 15 to 29 employees are required to register by May 15, 2026, and employers with 10 to 14 employees are required to register by July 15, 2026. (Employers with 30 or more employees were already required to register with the program by March 18, 2026.)
Employers who already offer retirement plans are still required to register to indicate that they have their own plan already. Employers who do not already offer a plan must then send information about their employees to the New York Secure Choice Program once they register.
Once employers who do not already offer a plan send employee information to the New York Secure Choice Program, their employees are permitted to opt out of participating in the plan, if they choose.
See pages 103 to 104 of the Tax Year 2025 M+O=CPE Individual Tax Reference Book for a discussion of the New York Secure Choice Program.
